OUC 2019 Liability Insurance

To view the OUC 2019 Liability Insurance full 45 page policy, click here

Liability Insurance is:

1- Insurance that protects you and your assets when somebody sues you for damages and or injuries you caused including death.

2- Liability settlements can render judgements in the MILLIONS OF DOLLARS.

Liability Insurance is NOT:

1- Medical insurance - However OUC's insurance does reimburse others for their medical expenses if they are injured as a result of OUC member activities up to $10,000. .

2- Travel insurance

3- Theft insurance

4- Hyperbaric insurance

5- Medivac insurance

While diving in Ontario, we do have medical insurance. However it is recommended and the consensus of many scuba divers that you invest in medical insurance specific to diving, especially when diving outside of Ontario.  DAN (Divers Alert Network) is the best known. You can use other medical providers.

The OUC Liability Insurance Policy is an "Occurrence" based policy. Please read the email exchange between Ron Bogart, SUCI President, and Nancy Au, VP Sports and Recreation for Pearson Dunn. They are the insurance broker. GameDay Insurance is the insurance provider.

Good morning:

To follow up on this, I spoke with Nancy Au at PD this morning and posed the following question:

  • I am an instructor and a current member of the OUC policy and teach a minor (aged 14) today.
  • I then decide to retire from diving (and instructing) a year later and cease my coverage in the OUC policy.
  • The minor decides to sue me when they are 19.
  • Am I still covered?

Nancy confirmed that under the “Occurrence Based” policy you would still be covered.

If anyone wishes to speak to Nancy directly with any additional specific questions or concerns, she is quite pleased to talk to you and answer them.

Cheers, Ron

Hi Ron,

It is on an ‘occurrence basis’.  You are correct in your thoughts.

Hi Ron,

On the first page of the policy declaration page it says (2) The ‘bodily injury or ‘property damage’ occurs during the policy period;…..   see attached.

A claims-made policy reads to indicate that the policy term to respond is the one in which the claim first becomes known and is reported to the insurer.

Let me know if you want to chat about it on the phone .
